9 Thirty Eighth Divisional Court

The Applicant’s legal team filed a motion in 2018 to appeal TLAB Chairman Ian Lord’s review decision refusing  an application to sever the property. They claimed grounds of procedural fairness.

A panel of three judges at Divisional Court unanimously found that Mr. Lord’s review decision followed TLAB’s rules and represented, in fact, a fair process. As a result, the appeal was dismissed and the refusal stands.
